## 1. Overview

When you complete your self-exclusion registration through the FMSA Platform, FMSA submits your NGB Form 1/1 to the National Gambling Board ("NGB") as your authorised representative, and communicates with the relevant provincial licensing authorities as part of its case-management and follow-up process. The statutory obligation to transmit the notice to all licence holders and provincial licensing authorities rests with the NGB under Regulation 2(4) of the National Gambling Regulations 2004. FMSA notifies the provincial gambling boards directly as part of its mandate to facilitate and follow up your application.

This notice explains exactly what information is submitted, to whom, and why.

## 6. Email Pattern

Every SE submission generates two emails:

**Email 1: Regulatory Submission (automated formal notice)**

```
FROM: exclusions@freemesouthafrica.co.za
TO:   National Gambling Board (info@ngb.org.za)
CC:   All 9 Provincial Gambling Boards (addresses above)
      FMSA shared exclusions inbox
BCC:  Applicant (silent copy - confirmation of dispatch)
      FMSA admin (internal monitoring)
Subject: [FMSA SE - FORMAL SUBMISSION] Self-Exclusion Application - [SE Number] - [Duration]
Attachments:
  - NGB Form 1/1 (signed, SHA-256 hash-stamped, PDF)
  - Proxy Consent and Authorisation Certificate (signed, PDF)
```

The applicant receives a silent (BCC) copy of this email for transparency. Their email address is not disclosed to the NGB or PGBs. This protects the applicant's personal data under POPIA Section 11 (data minimisation).

**Email 2: Applicant Certificate (separate, personal email)**

```
TO:   Applicant only
Subject: Your FMSA Self-Exclusion Submission Certificate - [SE Number] - FMSA
Attachments:
  - FMSA Self-Exclusion Submission Certificate (PDF, attached directly)
```

## 7. Operator Notification - Land-Based and Online

### 7.1 NGB's Obligation Under Regulation 2(4)

Following receipt of your NGB Form 1/1, the NGB is required by Regulation 2(4) of the National Gambling Regulations 2004 (GG No. 26994) to transmit a copy of the notice to **all licence holders** and provincial licensing authorities within seven days. "All licence holders" means every entity licensed under the NGA or applicable provincial gambling legislation, including:

- All land-based casino licence holders in all nine provinces
- All online gambling licence holders (licensed internet gambling operators including sports betting, casino games, bingo, and all other forms of licensed remote gambling)
- All gambling machine route operators, limited payout machine operators, and other licensed land-based operators

This means your exclusion record reaches every licensed gambling operator in South Africa, both land-based and online, through the NGB's statutory transmission obligation. You do not need to notify each operator individually.

### 7.2 FMSA's Monitoring and Follow-Up

Under Regulation 2(5)-(6), written confirmation of receipt triggers the effective date process. The NGB's registration of your exclusion, transmission, and the applicable effective date are controlled by the NGB and are beyond FMSA's control.

FMSA monitors for NGB acknowledgement of each submission. Where no acknowledgement is received within 24 hours, an automated follow-up is sent. After 72 hours without response, FMSA escalates to the NGB compliance office and, if necessary, the Department of Trade, Industry and Competition (DTIC).

### 7.3 Direct Operator Follow-Up by FMSA

Where FMSA has reason to believe that a licensed operator has not implemented an exclusion (for example, following a reported breach), FMSA is authorised under the Proxy Consent and Authorisation Certificate to communicate with that operator directly for the purpose of enforcement follow-up, and to report the suspected breach to the applicable Provincial Gambling Board.

## 8. Email Address Verification

All NGB and PGB contact details in this notice are sourced from each regulator's official website. FMSA does not manufacture or estimate email addresses. If any address changes, FMSA will update this notice and the platform configuration accordingly. Users may verify these addresses independently by visiting the official websites listed in Section 5.2.
